Terms of Service
Version: terms-2026-10-v1
Effective date: October 19, 2026
Who we are
These terms cover website design and care from Butler Media Group, Inc., doing business as Butler Studio ("we", "us"). Our mailing address is 120 19th St N Ste 201 PMB 827333, Birmingham, AL 35203-3219. Contact us at [email protected].
You confirm that you can act for the business named in your intake. We confirm the pages, scope, price, decision-maker and Care plan by email. Any change to these terms for your project must be agreed in writing by both parties. Submitting intake does not approve a design, authorize a payment or start a subscription.
We design first; you approve before payment
We design your website first. The standard build price is $2,000. You pay the full agreed build price only after you approve the finished site in writing, and before launch. There is no deposit, card requirement or automatic charge for a preview or intake. Silence is not approval.
The founding build rate is $1,200 for the first five clients, subject to availability and separate written case-study permission. We confirm eligibility, price, and the material and channels covered by that permission before work starts. No positive review is required. We will not publish a case study without that permission. A later change to permission does not automatically create an extra build charge.
If you do not approve the finished site, you pay nothing. Either party can end the unapproved project by email. We do not launch it, transfer unpaid custom files or start Care. On request, we delete the preview and the materials you supplied, subject to the limited legal-record exceptions in our Privacy Policy.
Scope, revisions and timing
The build includes up to five agreed core pages, phone and desktop layouts, editing of your permitted text and photographs, a basic contact route, search-ready titles and descriptions, LocalBusiness structured data, a sitemap, launch checks and help connecting your domain. Two revision rounds are included. Each round is one consolidated feedback list from your named decision-maker and our revised version.
We target the first full-site review within five business days of complete intake and written scope confirmation. This is a target, not a guaranteed launch date. Feedback, content, third-party services and access can affect timing. A new identity, extra pages, stores, custom systems, large migrations, photography and new features need a separate written quote and approval. Additional work never creates a charge without your written agreement.
You review the facts, hours, contact details, images and phone and desktop layouts before approving the finished site by email. We agree a launch date after approval and payment. If you do not reply for 30 days, we may send a status notice and pause work. A pause does not approve the site, authorize a charge or permit launch.
Your materials and permissions
You warrant that you own or have permission to use all text, photos, logos and other materials you provide. This also covers material we take from your existing website at your request. Being publicly visible does not give us permission to reuse it. You give us permission to copy and adapt these materials only as needed to design, preview, deliver and maintain your agreed site. You confirm that the business facts you approve are accurate.
Do not send passwords, recovery codes, payment-card details or sensitive personal information through intake. Use limited delegate access for accounts. If a licence or permission is missing, we must replace or remove the material before launch.
Ownership after full payment
On full payment of the build price, you own the site's design and content delivered specifically for you. Your pre-existing materials remain yours. Third-party licensed fonts and code remain subject to their own licences; we do not transfer rights that those licences do not allow. We provide the delivered site files and identify third-party licence requirements at handover. You are responsible for any separately disclosed third-party fees agreed before purchase.
Before full payment, you may review the preview but may not publish or reuse unpaid custom work. Cancelling Care after full payment does not remove your ownership. We can hand over the delivered files so you can arrange replacement hosting.
Care and Care Plus
Care is $100 per month. It includes hosting, monthly site and contact-route checks, and up to 30 minutes of small edits each month. Small edits include changes to existing text, hours and supplied photos. Unused edit time does not roll over.
Care Plus is $250 per month. It includes everything in Care, a Google Business Profile tune-up with your access and approval, a quarterly content refresh of existing pages, a review-request page and a monthly care report. We agree the profile work, refresh and review-page scope by email. New pages, redesigns and custom features need a separate quote. We do not charge twice for the review-request page included in Care Plus.
The plan you choose starts at launch, requires separate billing authorization, and renews month to month. You can cancel anytime by emailing [email protected]. Cancellation takes effect at the end of the current billing period. Service continues through that period, and no later renewal is due. Partial periods are not refunded unless required by law or agreed in writing. We confirm the end date and arrange file handover by email. These terms cover monthly Care; any different billing arrangement requires a separate written agreement before payment.
Hosting, domains and DNS access
We host the site through Cloudflare while Care is active. Hosting and uptime are best effort. Neither plan is a staffed emergency service or a promise of uninterrupted availability. We use reasonable efforts to resolve problems, but networks, third-party providers and planned maintenance can interrupt service. We do not guarantee search rankings, traffic, leads, revenue or sales.
You own and renew your domain in your own registrar account. Domain registration, renewals, business email hosting and paid third-party services are separate from the build and Care prices. We disclose any additional cost before you agree to it. You keep control of the domain and give us limited, revocable access to the DNS settings needed for launch. DNS means the records that connect your domain to the website and email services. We agree DNS changes in writing and preserve existing email records. Do not cancel your current hosting until the agreed cutover is complete.
When Care ends, our hosting ends at the close of the paid billing period. Arrange replacement hosting before then to avoid an interruption. We cooperate with the handover of paid-for files. Your domain and email accounts remain your responsibility.
Liability limits
To the fullest extent permitted by law, our total liability for claims arising from the services or these terms is limited to the fees you paid us for the services in the 12 months before the event giving rise to the claim. To that same extent, we are not liable for indirect, special, incidental or consequential losses, including lost profits, revenue or data. These limits do not exclude liability that the law does not allow us to limit, including fraud or wilful misconduct, or remove non-waivable consumer rights.
Privacy, changes and governing law
Our Privacy Policy explains how we use intake details, materials and acceptance records. We keep the accepted terms version with your intake. We may update these terms for future work. A change does not silently replace the terms of an existing project; any material change to that project requires written agreement.
Alabama law governs these terms, without its conflict-of-laws rules, subject to rights that applicable law does not allow either party to waive. Contact us by email first so we can try to resolve a concern in writing.
